What Is an Underage DUI Charge in Idaho?
Under Idaho Code § 18-8004(1)(e), a driver under 21 can be charged with DUI if they operate a motor vehicle with a BAC of 0.02% or higher. This is significantly lower than the 0.08% threshold for drivers 21 and older.
A single drink can be enough to put a young driver over the limit, and law enforcement officers have broad authority to stop and investigate suspected impaired driving.
An underage DUI may be charged in one of two ways:
- Standard underage DUI (BAC between 0.02% and 0.08%)
- Adult DUI (BAC of 0.08% or higher)
Underage DUI Penalties
Although a first-time underage DUI is classified as a misdemeanor, the penalties are still significant and may include:
- Fines up to $1,000
- Driver’s license suspension for up to one year
- Mandatory alcohol education or treatment programs
- Community service
- Probation
- Possible jail time of up to six months, particularly for higher BAC levels or repeat offenses
