What Qualifies as a Multiple DUI in Idaho?

A DUI offense is considered “multiple” if it occurs within a specific time frame following a prior conviction. In Idaho, the look-back period is 10 years. If you are arrested for DUI within 10 years of a previous conviction, it will be treated as a second or subsequent offense. The more convictions you have within that window, the steeper the penalties become.

Convictions from other states may be used as prior offenses if they were substantially similar to the current arrest.

A second DUI within 10 years is still a misdemeanor, but it carries significantly increased penalties compared to a first offense. A third DUI within 10 years is classified as a felony, with mandatory prison time and long-term consequences.

Penalties for Multiple DUI Convictions

Penalties for repeat DUI offenses in Idaho include the following.

Second DUI (within 10 years):

• Mandatory jail time - Minimum of 10 days, up to one year
• Fines - Up to $2,000
• License suspension - Minimum of one year, no restricted license available
